Scientology fights back in courtThe church is seeking a restraining order to stop a new round of protests.By Robert Farley, Times Staff Writer http://www.sptimes.com/2008/03/12/Northpinellas/Scientology_fights_ba.shtml CLEARWATER - With the Internet activist group Anonymous threatening a second round of protests against Scientology this weekend, the Clearwater-based church went to court late Tuesday, filing a petition for a temporary restraining order. The petition was filed just before the close of court Tuesday afternoon, and the St. Petersburg Times could not obtain a copy of the petition. Pat Harney, a spokeswoman for the Church of Scientology in Clearwater, confirmed the church had filed a request for a temporary restraining order, but on the advice of counsel, she refused to provide a copy of the lawsuit or discuss who it seeks to restrain. Anonymous, which describes itself as a loosely affiliated group united against the injustices perpetrated by Scientology, coalesced in January after a video of Scientologist Tom Cruise was leaked to YouTube and then promptly removed because of threats from Scientology attorneys. Members of Anonymous claimed this was an affront to the freedom of the Internet. A video message from Anonymous taunting the leaders of Scientology received more than 2-million views on YouTube. On Feb. 10, some 200 people participated in an Anonymous-organized demonstration against Scientology in downtown Clearwater. Similar protests were held in cities around the world. In Clearwater, church security videotaped and photographed protesters, most of whom disguised their faces with fake beards, face paint, scarves and bandannas. While Anonymous Web sites ask members to protest peacefully and state they mean no harm to Scientology's members, Harney said, "we have evidence to the contrary." Before the lawsuit was filed Tuesday, Harney said the church has documented threats made by members of Anonymous, and provided those threats to Clearwater police. "Of course, we are concerned about the safety of our group," Harney said. Representatives of Anonymous could not be reached for comment. This weekend's protests by Anonymous - dubbed "Party Hard" - were timed to coincide with Scientology's annual celebration of founder L. Ron Hubbard's birthday on Thursday. According to Web sites affiliated with Anonymous, members of the group plan to protest in 50 cities worldwide. In Clearwater, they will gather Friday evening outside Ruth Eckerd Hall, where Scientology will hold its annual gala event. A larger protest is planned Saturday in downtown Clearwater, where the church's international religious headquarters are located. "We are taking every security measure we can," Harney said. Church Of Scientology's Bid To Block Protesters Fails
CLEARWATER -- The Church of Scientology tried to stop protesters from returning to the sidewalks outside its headquarters this week by filing a type of petition in court usually used by women in fear for their safety. And in large part because of that approach, a Pinellas-Pasco circuit judge denied it late this afternoon. In a petition filed Tuesday, the church claimed the Internet-based group Anonymous wants to harm the church and its leaders – in particular the Rev. Heber Jentzsch, the president of the Church of Scientology International. The church also claims Anonymous has tried to harm the church in the past. The church's court maneuver comes a month after about 180 members of Anonymous gathered outside Scientology's headquarters Feb. 10 and conducted a peaceful protest. Members of the group vowed to return. In court lingo, the church was asking for an injunction for protection against repeat violence, which is more typically filed by women who say they are being beaten. Circuit Judge Linda R. Allan noted that the Church of Scientology is a corporation, not a person, and that the process the church's attorneys were seeking to stop the protesters is by law reserved for a "person who is the victim of repeat violence," according to a copy of her ruling. The statute "was clearly created for the protection of individuals," Allan wrote. "Certainly, counsel for the petitioners does not argue that a corporation can be the victim of the crime of battery or assault as that would be legally impossible." In the 21-page petition filed Tuesday, which is accompanied by dozens of exhibits, the church says members of Anonymous have threatened to commit acts of violence on the church and its members Thursday, which is the birthday of church founder L. Ron Hubbard. "Parishioners, officials, and leaders come to Clearwater and gather in large numbers at numerous events and services for this purpose," the petition states. "It is at this event that Anonymous has declared that it is their plan to assassinate or execute the Rev. Heber Jentzsch." The celebration is expected to continue Friday and Saturday. To support its request that protesters be kept 500 feet from Scientology buildings and Jentzsch, the church notes that Anonymous has posted detailed plans online for its protest on Saturday – including breaking its members up into "red, yellow and blue teams," maps of Scientology buildings and roads, and instructions that protesters use sunglasses, bandanas, hats and scarves to cover their faces. Initially, according to church, Anonymous attacked Scientology's Web sites, causing them to crash and be inoperable for days. Now, the church contends, Anonymous is advocating physical violence against the church, its leaders and parishioners. The church claims some members of the group have encouraged the use of bombs, hand grenades and machine guns. "Much of the violence has been encouraged and promoted through the posting of animated videos on the Internet Web site known as YouTube.com," the petition says. A DVD of those videos was attached to the petition. Among the signs the church says represent an escalation in attacks is a Feb. 28 911 call in which the caller said there was a man under the desk in the lobby of the Fort Harrison Hotel, a Scientology building in downtown Clearwater, and that the man was shooting people. More than a dozen squad cars responded before it was determined the call was a hoax. Though none of the members who protested in February gave the media their names, the church has found out the identities of more than 20 people they say are associated with Anonymous. CLEARWATER -- Circuit Judge Douglas Baird today denied a motion for a temporary injunction sought by the Church of Scientology to prevent protesters from getting within 500 feet of Scientology buildings. A group of protesters calling itself Anonymous plans demonstrations against Scientology Friday and Saturday, coinciding with the church's birthday celebration of its founder, L.Ron Hubbard. This is the second of two similar suits filed by the Church of Scientology this week. The first was rejected by Circuit Judge Linda Allan on Wednesday. "This court is mindful of the anxiety that may be caused by anonymous threats of violence, or as a series of seemingly unconnected incidents, be they on the internet or otherwise,'' Baird wrote. "However, the jurisdiction of the court must only be exercised to specifically restrain those known individuals that are shown to have some reasonable nexus to the actual threats complained of in the petition. "Here, as alleged in the petition, there appears to be a number of individuals who more or less refer to their cause as "\"Anonymous,'' but there is no allegation of the existence of any organization or hierarchy of command that exercises any form of collective or coordinated action that results in the systematic deprivation of the petitioner's rights." Scientology Foes Returning To Clearwater Saturday
CLEARWATER - There's no question the city's movers and shakers want to bring more people to their struggling downtown core. But masked protesters carrying signs and clogging sidewalks, possibly disrupting commerce and keeping some visitors away? That's what's on tap for Saturday when the group Anonymous steps out from the shadows of the Internet to hold a second round of protests against the Church of Scientology. "I don't think it helps, but obviously people have the right to protest as long as it's peaceful and they're not infringing on someone else's rights," Mayor Frank Hibbard said. "We won't allow that to happen, either." Anonymous is holding its second protest in as many months in downtown Clearwater, site of the church's spiritual headquarters. The demonstration is timed to coincide with the church's observance this weekend of the birthday of its founder, L. Ron Hubbard, which was Thursday. This week, the church went to court twice to ask for a restraining order against Anonymous, but the request was denied both times. Most of the protesters are in their late teens and early 20s. They wear wigs, sunglasses, bandannas and hats to disguise their identities, saying they fear retribution from Scientologists. Church spokeswoman Pat Harney has compared Anonymous to the Nazis and Ku Klux Klan. The last protest, on Feb. 10, drew about 180 demonstrators. Similar protests were held worldwide to mark the birthday of Lisa McPherson, a Scientologist from Clearwater who died in 1995 while under the care of the organization. Clearwater police said there were no major incidents or arrests. "We will have a police presence," said Elizabeth Daly-Watts, Clearwater's public safety spokeswoman. "As far as details, I can't get into it because of security purposes." Hibbard said he hopes such demonstrations do not become a regular occurrence downtown, which political and business leaders are working to revitalize after years of dormancy. Then again, the influx of protesters could be a good thing, said Dwight Matheny, executive board chairman of the Clearwater Downtown Partnership, which promotes downtown and events that bring in people. "The hope is that anybody who comes downtown, whether it's a festival or a protest or whatever, … they'll find out that downtown is a pretty nice place and they'll want to come back," he said. "Certainly notoriety, good or bad, does help in many ways." Matheny said there likely will be some disruption to regular business activity, but he hopes it will be minimal. Interessant war, dass es im Prozess darum ging, weil gesagt wurde Barbier sei krank. Zum Prozess ist er dann nicht erschienen mit der Begründung ... dass er Krank sei... Art. 19 Art. 20 Irgendwie 'logisch' vom Gericht, diesen Sachverhalt zu bestätigen, daraufhin jedoch Jean-Luc Barbier trotzdem zu bestrafen :-) Wirft ein seltsames Licht auf einen dubiosen Richter, der beispielsweise eine Erkältung mit einer verleumderischen Unterstellung einer psychischen Erkrankung, die einer psychiatrischen Abklärung bedarf, gleichstellt.
